Frequently asked questions

What are trademark classes?
Every trademark is registered for specific goods or services, grouped into 45 classes under the Nice Classification. Classes 1–34 cover goods and classes 35–45 cover services. India follows the Nice Classification under the Trade Marks Rules, 2017, so the class you choose decides what your registration protects.
Can I register my trademark in more than one class?
Yes. India allows a single multi-class application, but the government fee is charged for each class: ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for others (e-filing). Most businesses need one to three classes.
What happens if I choose the wrong class?
Your registration only protects the goods or services in the classes you filed. You cannot add a new class to an application already filed — that needs a fresh application — and the description of goods or services can be narrowed later but not widened. Choosing the classes carefully at the start avoids paying twice.
Which class is a mobile app or software in?
Downloadable software and mobile apps fall in Class 9. If you provide the software online as a service (SaaS) or run an online platform, Class 42 also applies. Many app businesses add the class of the service the app delivers too — for example Class 41 for an education app or Class 39 for a delivery app.
Which class is a restaurant, café or cloud kitchen in?
Restaurant, café, catering and cloud-kitchen services fall in Class 43. If you also sell packaged food under the brand, add the food classes — Class 30 for items like spices, sweets, bakery products and snacks, or Class 29 for items like pickles, ghee and dairy.
Which class is a clothing brand in?
Clothing, footwear and headwear are in Class 25. If you run your own shop or online store, Class 35 protects the retail service. Related products sit in other classes: bags and wallets in Class 18, jewellery and watches in Class 14.
Is the class suggested by this tool final?
The tool suggests the most likely classes based on common products and services. The exact class depends on how your goods or services are described, so it is worth confirming before filing. Vakil Help Desk can confirm the class and run an availability search; we work on economical, reasonable professional fees and share a transparent quote before starting.
