A Dowry Demand After Marriage Is Punishable — No Prior 'Dowry Agreement' Needed: High Court

Vakil Help Desk News: the Madhya Pradesh High Court has held that a dowry demand made after marriage is punishable under Section 4 of the Dowry Prohibition Act even without any pre-marriage dowry agreement, and that such a demand can be proved by oral evidence. It restored a conviction that an appellate court had set aside.

Vakil Help Desk News, Litigation & Courts. A common misconception is that a dowry case needs proof of a dowry “deal” fixed before the wedding. The Madhya Pradesh High Court (Indore Bench), in a judgment by Justice Alok Awasthi, has clarified that this is not so.

The dispute

A wife had alleged that, after marriage, her in-laws demanded a large sum, harassed her, and turned her out when it was not paid. The trial court convicted the husband and father-in-law under Section 498A of the IPC and Section 4 of the Dowry Prohibition Act; the appellate court acquitted them. The wife challenged that acquittal.

What the Court held

  • A prior dowry agreement is not a condition for an offence under Section 4 — the law covers property given or agreed to be given at, before, or after the marriage.
  • A post-marriage demand for money can be proved by oral testimony; there is no rule requiring documentary proof.
  • Minor inconsistencies between witnesses, years after the events, did not make the evidence unreliable.
  • The appellate court had shown no defect serious enough to overturn the trial court; the husband's conviction was restored.
  • The father-in-law's conviction was not restored, because criminal liability does not survive the death of the accused.

Why it matters

Dowry harassment often continues, or begins, after the wedding — and victims may fear they have no case because nothing was written down or agreed beforehand. This ruling confirms that the law reaches post-marriage demands, and that a victim's testimony can be enough.
