DPDP Act 2023 — AI & Privacy Governance

AI & Data Governance Consulting

Artificial intelligence systems are the most complex personal data processing challenge of our era. They collect, infer, profile, and make decisions about individuals at a scale no human process can match — and they do it in ways that are often opaque, hard to explain, and difficult to audit. We help businesses build AI systems and data ecosystems that are privacy-compliant, ethically sound, and defensible under the DPDP Act 2023 and emerging global AI governance frameworks.

The Challenge

Why AI Systems Create Unique and Serious Data Privacy Risks

Traditional data protection frameworks were built for humans processing data in defined, auditable ways. AI changes everything. A recommendation engine, a fraud detection model, a hiring algorithm, or a customer chatbot processes personal data in ways that are often unpredictable, unexplainable, and invisible to the individuals affected. Without intentional governance, every AI system is a potential DPDP Act liability.

🔮

Inferred Personal Data

AI models don't just process the data you give them — they infer new personal data from it. A model can infer health conditions from purchase history, political views from browsing patterns, or financial stress from location data. Inferred data is personal data under the DPDP Act — and users never consented to its creation.

🚫

Automated Decision-Making

Loan approvals, hiring decisions, insurance pricing, and credit scoring driven by AI algorithms make significant decisions about individuals without human review. DPDP Act and emerging AI frameworks require explainability, contest rights, and human oversight for high-stakes automated decisions.

🎯

Unlawful Profiling

Building detailed behavioural, psychological, or demographic profiles of users for advertising targeting or content personalisation without explicit consent is a direct DPDP violation. Profiling requires specific consent and disclosure — most current implementations have neither.

🔗

Training Data Liability

AI models trained on personal data without valid consent, proper anonymisation, or documented legal basis create permanent compliance liability. Every prediction a non-compliant model makes is based on unlawfully processed personal data — and the liability compounds with every use.

Frameworks We Apply

AI & Data Governance Frameworks We Work With

We align your AI governance with every major framework your business may need to satisfy — now or as you scale internationally.

🇮🇳

DPDP Act 2023

India's primary data protection law — the foundation of all our AI governance advice. We ensure AI systems meet consent, purpose limitation, data minimisation, and rights requirements under the Act.

🇪🇺

EU AI Act

The world's first comprehensive AI regulation — risk-based classification of AI systems, prohibited AI practices, transparency requirements, and human oversight obligations. Applies to any AI system used in the EU market.

🛡️

GDPR (Article 22)

GDPR's automated decision-making provisions — right to human review, right to contest, and requirement to explain automated decisions. Critical for AI serving European users or companies.

🏛️

NIST AI RMF

The US National Institute of Standards and Technology AI Risk Management Framework — the globally recognised standard for identifying, measuring, and managing AI-related risks across the full model lifecycle.

📋

ISO 42001

The international standard for AI management systems — providing a structured approach to responsible AI development, deployment, and monitoring. The AI equivalent of ISO 27001 for information security.

🇮🇳

MeitY AI Guidelines

India's Ministry of Electronics and IT advisory guidelines on responsible AI — covering transparency, accountability, safety, inclusivity, and privacy principles specific to the Indian regulatory and social context.

Who We Help

Businesses That Need AI Governance Advisory

🤖

AI Product Companies

Businesses building AI-powered products — chatbots, recommendation engines, fraud detection, computer vision, NLP tools — that process personal data as their core input or output.

How We Work

Our AI Governance Engagement Process

1

AI Inventory & Discovery

We map every AI system and automated decision process in your organisation — internal tools, customer-facing models, third-party AI integrations, and data pipelines feeding AI. This inventory becomes the foundation for all governance work and identifies your highest-priority compliance risks immediately.

Week 1 Full AI map
2

Risk Assessment & Gap Analysis

Each AI system is assessed against applicable frameworks — DPDP Act, EU AI Act risk classification, NIST AI RMF categories, and sector-specific regulations. We identify every gap between your current practices and required standards, with risk severity ratings and prioritised remediation recommendations.

FAQs

Frequently asked questions

Does the DPDP Act apply to AI systems?
Yes, whenever an AI system processes digital personal data — for training, fine-tuning or running features on user data. The usual duties apply: a lawful basis, notice, purpose limitation, security, accuracy and retention limits.
Can we train AI on publicly available data?
The Act does not apply to personal data that the individual has made publicly available, or that is made public under a legal obligation. Data scraped from other sources, or data that the person did not make public, still needs a lawful basis.
What is a DPIA and do we need one?
A Data Protection Impact Assessment evaluates the risks of a processing activity to individuals. Significant Data Fiduciaries must carry one out every year; for others it is good practice for high-risk AI use.
What does AI governance consulting include?
An inventory of AI use cases and data, risk assessment, vendor and model contract terms, internal AI use policies, and notices and consent for AI features. We work on economical, reasonable professional fees and share a transparent quote before starting.
