Questions, answered

DPDP compliance — frequently asked

The questions businesses ask us most often about the DPDP Act and our platform.

What is the DPDP Act 2023, and does it apply to us?
The Digital Personal Data Protection Act, 2023 is India's data-protection law. It applies to almost any business that collects or processes the personal data of individuals in India — from a small online store to a large enterprise. If you hold customer, user or employee personal data, it applies to you.
When do the obligations come into effect?
The Act is passed and its Rules are being finalised, with core obligations expected to be enforced around 2027. Compliance takes time to build — discovery, consent, policies, training and audit — so organisations that start early are far better placed when enforcement begins.
What is the difference between a Data Fiduciary and a Significant Data Fiduciary?
A Data Fiduciary is any entity that decides how and why personal data is processed. A Significant Data Fiduciary (SDF) is a class notified by the Government based on factors like the volume and sensitivity of data; SDFs have extra duties — appointing a DPO, conducting periodic DPIAs, and an independent data audit. Our platform supports both, and the audit module is built for SDFs.
Do we need to appoint a Data Protection Officer (DPO)?
A Significant Data Fiduciary must appoint a DPO based in India. Other fiduciaries must at least publish contact details of a person who can answer data-principal questions. Our DPO toolkit and grievance workflow cover both situations, and our team can act as, or support, your DPO.
What are the penalties for non-compliance?
The Act provides for significant financial penalties, which can run up to ₹250 crore for a single instance of failing to take reasonable security safeguards to prevent a data breach, with other defaults carrying their own penalties. The amount is decided by the Data Protection Board based on the nature and gravity of the breach.
How is this different from a DIY policy generator?
A generator gives you a document. We give you the full lifecycle — discovering where your data actually lives, protecting it, running consent and rights, and proving compliance through audit — and, because we are lawyer-led, we set it up with you rather than handing over a tool and leaving. Compliance is an ongoing obligation, not a one-time PDF.
Can you help us find where our personal data is stored?
Yes. Our PII Discovery module scans your systems and data to find where personal data (PII) actually lives, and the website & cookie scanner checks your domains for trackers and data collection. This mapping is the foundation of everything else under the Act.
Is our data secure on the platform?
Personal data is protected with field-level encryption and secure key management, and every access to data and keys is logged. Consent records are kept in a tamper-proof, hash-chained trail, and a full activity log runs across the platform for accountability.
Do you support our industry?
We configure the same platform around your sector's data and obligations — banking, fintech, healthcare, e-commerce, SaaS, education, real estate & housing, HR and more. If your industry isn't listed, we tailor it to your data flows during setup.
