A registered trademark in India lasts 10 years. When to renew, the government fee per class, the six-month grace period, restoration and what to do if you've missed the deadline.
Short answer: a registered trademark in India is valid for 10 years and can be renewed every 10 years, indefinitely. You can file the renewal (Form TM-R) up to one year before expiry. The government fee is ₹9,000 per class (e-filing). Miss the date and you have six months to renew with a surcharge, then a further six months to apply for restoration.

How long does a trademark last?

A trademark registration lasts 10 years. The period runs from the date of application, not the date the certificate was issued — so a mark applied for in March 2017 and registered in 2019 still expires in March 2027.

When to renew

Renewal can be filed up to one year before the expiry date. The Registry usually sends a reminder notice before expiry, but do not rely on it — keep the date in your own calendar.

Government fees (e-filing, per class)

When you renewFee per classWhat it covers
Before the expiry date₹9,000Renewal (Form TM-R)
Within 6 months after expiry₹13,500Renewal plus a ₹4,500 surcharge for the delay
6 to 12 months after expiry₹18,000Restoration and renewal, at the Registrar's discretion

Paper filing costs a little more. Unlike new applications, the renewal fee is the same for every applicant — individuals, startups and companies alike.

What happens if you miss the deadline?

  1. First six months after expiry: the mark is still on the register. Renew it with the surcharge.
  2. After six months: the Registrar can remove the mark from the register.
  3. Up to one year after expiry: you can apply to restore and renew it. Restoration is not automatic; you should explain the delay.
  4. After that: you will usually need to file a fresh application — and someone else may have filed for the same mark in the meantime.

Documents and process

  • The trademark registration number and class.
  • Owner details exactly as on the register. If the owner's name or address has changed, or the mark has been assigned, record the change first or alongside the renewal.
  • Authorisation for the agent or advocate filing for you.

Renewal is filed online on the IP India portal, and the register is updated once it is processed. There is no fresh examination of the mark.

Is it worth renewing?

If you still use the brand — or plan to — almost always yes. A lapsed registration loses the presumption of ownership that makes enforcement straightforward, and the brand can become available to others. If you no longer use the mark in some classes, you can choose to renew only the classes you need.
