Your RWA Wants to Ban Your Pet? It Can't

Blanket 'no pets' rules, bans on pets in lifts or parks, fines and harassment of pet owners — animal-welfare guidelines and the courts have repeatedly held these illegal. An RWA can make reasonable conduct rules, not prohibitions.
In plain words: an RWA cannot ban pets or harass pet owners. Animal-welfare guidelines and the courts have repeatedly held that blanket pet bans are illegal. An RWA may frame reasonable conduct rules, but it cannot prohibit keeping a pet.

The problem

A committee passes a 'no pets' rule, or bars pets from lifts, parks and common areas, imposes fines, and pressures pet owners to give up their animals — turning daily life into a running battle.

What the law says

  • Blanket pet bans are illegal. The Animal Welfare Board of India (AWBI) has issued guidelines, and courts have held, that RWAs cannot impose a total ban on keeping pets, nor force owners to remove them. A sub-committee or a majority vote cannot override this.
  • Cruelty is an offence. Harassing animals or their owners can attract the Prevention of Cruelty to Animals Act, 1960.
  • Reasonable rules are allowed. An RWA can frame sensible, non-discriminatory conduct norms — leashing in common areas, cleaning up, vaccination — but not a prohibition.
  • Act within RWA powers. A pet 'ban' is also beyond the RWA's powers under the HRRS Act, 2012 and therefore invalid (sections 34(2), 37(4)).

What you can do, step by step

  1. Ask for the legal basis of the pet rule, in writing.
  2. Cite the AWBI guidelines and the settled position that blanket bans are illegal.
  3. Complain to the District Registrar and, where relevant, the AWBI; and approach the police if there is harassment or cruelty.
