You have spent months — perhaps years — building your mobile app, SaaS platform, or software product. Your code, your UI, your database structure, and your algorithms are all original creative work. But did you know that without copyright registration, proving ownership of your software in a legal dispute can be an uphill battle? In India, software and computer programs are protected as literary works under the Copyright Act, 1957 — and registration is one of the smartest legal steps any developer, startup, or IT company can take. Here is everything you need to know.
Is Software Eligible for Copyright Protection in India?
Yes — absolutely. Under Section 2(o) of the Copyright Act, 1957, computer programmes are explicitly included in the definition of literary works and are therefore eligible for copyright protection. This covers:
Software & Code
- Source code
- Object code
- Scripts & algorithms
- Database structures
- APIs & SDKs
Apps & Platforms
- Mobile apps (Android/iOS)
- Web applications
- SaaS platforms
- ERP / CRM systems
- E-commerce platforms
Digital Content
- UI/UX design files
- Website code & templates
- Training datasets
- Firmware & embedded code
- Game engines & logic
Why Should You Register Your Software Copyright?
Copyright arises automatically upon creation — you do not legally need to register it. So why bother registering? Here are six compelling reasons:
◆ Legal Proof of Ownership
A registration certificate is prima facie evidence of ownership in Indian courts. Without it, proving you created the software first is far more difficult and expensive.
◆ Deters Copying & Piracy
A registered copyright publicly notifies competitors and potential infringers that your software is legally protected — making them think twice before copying it.
◆ Enables Licensing & Monetisation
A registered copyright makes it easier to license your software to third parties, enter into SaaS agreements, or sell the IP — as ownership is clearly documented.
◆ Investor & Due Diligence Ready
Investors and acquirers check IP ownership during due diligence. A registered copyright demonstrates that your core technology asset is legally secured.
◆ Protection Against Ex-Employees
A common dispute in IT companies is ex-employees claiming they own the code they wrote. A copyright registered in the company's name significantly strengthens your position.
◆ Very Low Cost
The government fee for software copyright registration is just ₹500 per work — making it one of the most affordable IP protections available in India.

Documents Required for Software Copyright Registration
- 1 Name, Address & Nationality of the Applicant — the individual, startup, or company that owns the software
- 2 Name, Address & Nationality of the Author(s) — the developer(s) who wrote the code. If the software was created by employees in the course of employment, the company is typically the first owner
- 3 Title / Name of the Software — the name of the application, program, or platform being registered
- 4 Source Code — First 10 and Last 10 Pages — the Copyright Office requires the first 10 pages and last 10 pages of the source code. If the total source code is less than 20 pages, submit the entire code. Confidential or proprietary sections may be redacted
- 5 Year of Creation / Publication — when the software was first created and/or published or made available to users
- 6 NOC from Author (if applicable) — if the applicant is a company and the author is a freelancer or third-party developer (not an employee), a No Objection Certificate from the author is required
- 7 Power of Attorney — authorising Vakil Help Desk to file and follow up on the application on your behalf
Step-by-Step Process for Software Copyright Registration
The process follows the standard copyright registration procedure under the Copyright Act, 1957.
Document Preparation
We help you prepare all required documents — including the source code pages, applicant and author details, NOC (if applicable), and Power of Attorney. This is the most important preparatory step and we ensure everything is in order before filing.
Filing the Application (Form XIV)
We file your copyright application online on the official Copyright Office portal. A Diary Number is issued immediately upon successful filing — this serves as your official acknowledgement and proof of application date.
Diary number issued immediately on filing30-Day Mandatory Waiting Period
After filing, there is a statutory waiting period of 30 days during which any third party who claims an interest in the work can file an objection. This applies to all copyright applications, including software.
Statutory 30-day waiting periodExamination & Scrutiny
The Copyright Examiner reviews the application for completeness and compliance. If any discrepancy or clarification is required, we respond promptly on your behalf. This stage is generally straightforward for software applications that are properly prepared.
✓ No Issues
Application moves forward to registration directly.
△ Discrepancy Found
We file a response or clarification. A hearing before the Registrar may be scheduled if needed.
Registration Certificate Issued
Once examination is complete, the Copyright Office registers your software and issues an official Copyright Registration Certificate. Your software is entered in the Register of Copyrights maintained by the Copyright Office. The certificate serves as legal proof of ownership.
Certificate issued — valid for lifetime of author + 60 yearsHow Long Does It Take?
| Scenario | Estimated Time |
|---|---|
| No objection, smooth process | Around 6 months |
| With discrepancy or clarification required | 6–12 months |
| With third-party objection and hearing | 1–2 years |
Software Copyright vs Patent — Which Do You Need?
This is one of the most common questions from developers and tech founders. Here is a simple comparison:
| Aspect | Copyright | Patent |
|---|---|---|
| What it protects | The code / expression | The technical invention / process |
| Government fee | ₹500 | ₹1,600 – ₹8,000+ |
| Time to get protection | 3–6 months | 3–6 years |
| Duration of protection | Life of author + 60 years | 20 years from filing |
| Protects ideas / algorithms? | No | Possibly (if novel & inventive) |
| Best for | All software & apps | Novel technical processes & systems |
